Pre-Order Sales Terms and Conditions
KAWAGUCHI Co., Ltd. (hereinafter referred to as "the Company") establishes the following terms and conditions (hereinafter referred to as "these Terms") regarding the sale of Company products designated as subject to pre-order sales (hereinafter referred to as "Pre-Order Sales"). Matters not specified in these Terms shall be governed by the Terms of Use of the Company's online store (hereinafter referred to as "Terms of Use").
Article 1 (Scope of Application)
These Terms apply to users (hereinafter referred to as "Users") who purchase products related to Pre-Order Sales on the Company's online store (hereinafter referred to as "the Online Store"). Users shall be deemed to have agreed to the contents of these Terms by applying to purchase products related to Pre-Order Sales from the Company.
Article 2 (Application for Pre-Order Sales)
- When purchasing products related to Pre-Order Sales, Users shall apply for the purchase of said products by providing information specified by the Company in accordance with the conditions and methods designated by the Company.
- The Company may decline applications for Pre-Order Sales in cases where it is discovered that the User has previously had their membership registration deleted due to violations of the Terms of Use of online stores operated by the Company or its affiliated companies, where it is discovered that the User has previously resold products of the Company or its affiliated companies to third parties, where false information is included in the input content, or in other cases where the Company determines that accepting the Pre-Order Sales is inappropriate.
- When accepting an application as stipulated in Paragraph 1, the Company shall send an email to the User's email address stating the expected shipping time of the product related to the application. However, in the case specified in Article 3, Paragraph 2, this email will be sent after the completion of the payment specified in that paragraph.
- If there are any changes to the shipping address, name, or telephone number specified to the Company at the time of application for Pre-Order Sales before the delivery of products related to Pre-Order Sales, the User shall notify the Company by email, telephone, or other methods.
Article 3 (Credit Screening and Payment)
- Payment for the price of products related to Pre-Order Sales and other expenses shall be made by credit card payment.
- Users shall provide credit card information to the Company at the time of application for Pre-Order Sales and agree to the payment of the price of products related to Pre-Order Sales and other expenses. In this case, payment will be processed immediately after the application for Pre-Order Sales using the credit card information entered at the time of application.
Article 4 (Delivery and Delivery Timing)
- The Company will deliver products to the shipping address specified by the User when applying for Pre-Order Sales as soon as the ordered products are ready for shipment. However, Users understand that due to the nature of Pre-Order Sales, a certain period of time is required before product delivery, and acknowledge in advance that the delivery timing of products related to Pre-Order Sales may be later than the expected delivery timing notified in Article 2, Paragraph 3, due to product manufacturing status, delivery status, or other reasons.
- When a User orders multiple products related to Pre-Order Sales, all pre-ordered products will be shipped once they have all arrived in stock.
Article 5 (Handling of User Information)
- The Company will handle information obtained from Users regarding Pre-Order Sales applications in accordance with the Company's Privacy Policy.
- In principle, the Company will not disclose information obtained from Users to third parties. However, the Company may disclose information to contractors entrusted with Pre-Order Sales-related tasks, such as product delivery, to the minimum extent necessary.
Article 6 (Cancellation of Pre-Order Sales)
- Users shall not be able to cancel sales contracts related to Pre-Order Sales after such contracts have been established.
- The Company may immediately cancel sales contracts related to Pre-Order Sales without prior notice in the event of any of the following circumstances:
(1) When the User has engaged in or is likely to engage in conduct that violates these Terms
(2) When there is or has been a failure by the User to fulfill obligations related to transactions through the Online Store
(3) When payment with the credit card specified by the User pursuant to Article 3, Paragraph 1 is not completed
(4) When the delivery address is unknown, the User is absent for an extended period, or the User refuses to accept the product (including cases where the User does not accept the product at the specified shipping address for an extended period)
(5) When the manufacture, delivery, or sale of Pre-Order Sales products to the User becomes impossible due to force majeure or other reasons
In addition to the preceding paragraphs, when the User has engaged in conduct that the Company reasonably deems inappropriate or when the Company determines that it is appropriate to cancel the sales contract related to Pre-Order Sales
Article 7 (Disclaimer)
- The Company shall be deemed to have fulfilled its notification obligations to Users by sending notifications to the email addresses entered by Users in advance. The Company shall also be deemed to have fulfilled its obligations related to the delivery of products related to Pre-Order Sales by delivering products to the shipping address specified by the User at the time of application for Pre-Order Sales.
- The Company does not guarantee in any way that Pre-Order Sales will be suitable for any specific purpose of Users, that products related to Pre-Order Sales will have the expected product value, accuracy, or usefulness, that the use of Pre-Order Sales by Users will comply with laws applicable to Users or internal rules of industry organizations, or that no defects will occur.
- The Company shall not be liable for any damages, losses, or disadvantages incurred by Users from causes not attributable to the Company in connection with the use of Pre-Order Sales, regardless of the legal basis for the claim.
- All costs, such as communication expenses, required for Users to use services related to Pre-Order Sales shall be borne by the Users themselves.
Article 8 (Priority Relationship)
In the event that the provisions of these Terms differ from or conflict with the provisions of the Terms of Use of the Online Store, the provisions of these Terms shall take precedence.
